IT'S ZONED PS-2 AND IT'S NONCONFORMING OUTDOOR CAR REPAIR. THERE'S A LITTLE DIRT ROAD AND THEY PARK THE CARS ALONG IT. WHEN YOU GO DOWN THIS END OF MILLER STREET IT HAS A PARTICULAR CHARACTER TO IT.
WE THINK THE IMPROVEMENTS WILL BE THE NICEST THING OUT THERE ACTUALLY.
WE'LL MEET THE CODE FOR LANDSCAPING AND BUFFERING, NEW BUILDINGS, STORM WATER TREATMENT AS REQUIRED BY THE DISTRICT.

THE PURPOSE OF THIS CHANGE WAS TO ACCOMMODATE BRINGING THAT VILLAGE CENTER AREA THAT WAS PREVIOUSLY IN THE CATHEDRAL OAK PARKWAY RIGHT OF WAY UP INTO THE PARCEL SO WE COULD ALLOW FOR MORE NONRESIDENTIAL DEVELOPMENT. IT ALLOWS US TO MEET THE INTENT OF THE VILLAGE CENTER IN PROVIDING THE RATIOS REQUIRED BY THE MASTER PLAN COMMUNITY. AS DOTTY MENTIONED, THIS MAP SHOWS THE DIFFERENCES BETWEEN THOSE. WHERE WE HAVE THE DIVOTS COMING OUT OF THE CIRCLE, THOSE ARE ACCOMMODATING THE LINE WORK THAT'S IN THERE. WE'RE CHANGING 17. 3 ACRES FROM VILLAGE CENTER TO MPC.
IT'S AN EVEN TRANSFER CONSISTENT WITH THE LAKE ASBURY MORATORIUM. THE ZONING MAP IS THE SAME PROPOSAL AS THE FUTURE LAND USE APPLICATION.
THE ZONING REFLECTS THE SAME CHANGES.
IN AUGUST OF 2024 THE APPLICATION HAD A DRC FOR THE MASTER SITE PLAN. IT WAS APPROVED BY STAFF.
DURING THAT TIME WE HAD CONVERSATIONS.
WE HAD SHOWN THESE AREAS OF VILLAGE CENTER TO BE VACANT WHERE THE COMMERCIAL PLANS WERE INTENDED AND THEN YOU HAD THE RESIDENTIAL PORTIONS AND THE COMMUNITY FARM AND RECREATIONAL PORTIONS. DURING THE CONVERSATIONS OF THE DRC APPLICATION, WE MET WITH STAFF AND SAID IT WAS INTENDED A SMALL USE AMENDMENT WOULD BE COMING IN THE FUTURE. AS FOR THE ADDITIONAL INFORMATION OF THIS APPLICATION, THE CHANGE OF THE LAND USE IS TO BE MORE SENSITIVE TO WETLAND IMPACTS, REDUCES THE ENVIRONMENTAL CONSTRAINTS, ENHANCES CONNECTIVITY BETWEEN RESIDENTIAL AND NONRESIDENTIAL USES.

IN THE STAFF REPORT IT MENTIONED A BALD EAGLE NEST LOCATION IN THE NORTHERN PORTION OF THE SITE. THAT BALD EAGLE NEST WAS LAST RECORDED ACTIVE IN 1995. WHEN OUR ENVIRONMENTAL CONSULTANT WENT OUT TO THE SITE IN 2023, THERE WAS NO RECORD OF THE NEST ANYMORE.
THAT WAS PROVIDED TO STAFF IN A FULL DUE DILIGENCE ANALYSIS.
LASTLY, IN SUMMARY, THIS PROPOSED CHANGE IS FOR A TOTAL OF 35. 66 ACRES. THERE'S NO INCREASE IN THE DENSITY OR INTENSITY. IT IS CONSISTENT WITH THE MASTER DRC SITE PLAN APPROVAL AND CONVERSATIONS HAD WITH STAFF. IT'S FURTHER CONSISTENT WITH THE COME PRE WHEN PREHENSIVE PLAN
