AND THEN, THE BOAT GARAGE IS APPROXIMATELY 750 SQUARE FEET TO BE PLACED IN THE FRONT SIDE YARD. THEN, BOA 25-0002 IS TO ALLOW FOR A VEHICULAR GARAGE, APPROXIMATELY 416 SQUARE FEET TO BE PLACED ON THE WEST SIDE YARD ADJACENT TO THE EXISTING HOME.

EXCUSE ME. SO, THIS IS THEIR PROPERTY. YOU CAN SEE THE HOUSE LOCATION IN THE MIDDLE OF THE PROPERTY AS OPPOSED TO IN THE FRONT. THE PARCEL IS LOCATED ON THE SOUTH SIDE OF HOLLYWOOD FOREST DRIVE, EAST OF PINE AVENUE, WEST OF HARVEY GRANT ROAD. APPROXIMATELY 1.8 ACRES. THEY PURCHASED THE PROPERTY IN 2022, ACCORDING TO THE PROPERTY APPRAISER. THE HOUSE WAS BUILT ON THE PARCEL IN 1972 IN ITS CURRENT LOCATION. THERE IS A SEPTIC DRAIN FIELD AND A WELL LOCATED IN THE REAR OF THE PROPERTY. THE MINIMUM SETBACK FOR THE RA ZONING DISTRICT, WHICH AT THIS HOME IS A PART OF, IS 40 FEET. THE HOME IS APPROXIMATELY 211 FEET OFF THE PROPERTY, AS YOU CAN SEE HERE.

THE HOUSE IS TO THE EAST AND WEST ARE APPROXIMATELY 40 FEET OFF OF THE FRONT SETBACK LINE AND THERE'S IS KIND OF AN ANOMALY. THE APPLICANT DESIRES TO PUT THE ACCESSORY BOAT GARAGE TO THE FRONT OF THE HOME TO ACCESS THE EXISTING DRIVEWAY, ALTHOUGH THIS WOULD TECHNICALLY BE THE APPLICANT FRONT YARD.

PLACEMENT OF THE IS EXTENDING HOME OF MORE THAN FIVE REQUIRED SETBACK, THE GARAGE SHOULD NOT BE PHYSICALLY ACCESSIBLE FROM THE ROAD. IT IS MY OPINION THAT THE MAJORITY OF THE PARCEL IS SUBSTANTIALLY WOODED ALONG HOLLYWOOD FOREST DRIVE AND THE PLACEMENT OF THE ACCESSORY STRUCTURE TO THE REAR OF THE PROPERTY WOULD HAVE A DETRIMENTAL EFFECT ON THE FLOODWAY THAT ALSO EXISTS ON THE REAR OF THE PROPERTY. THIS IS A GRAPHIC OF THE FLOODWAY THAT GOES ALONG EAST TO WEST ON THE REAR OF THE PROPERTY. THEN THE SEPTIC FIELD AND WELL IS JUST

ABOVE THAT. THE SPECIAL CONDITIONS. AS I SAID, THE HOUSE WAS BUILT IN 1972 IN ITS CURRENT CONFIGUATION. AND, THE EXISTING FLOODWAY FROM WEST TO EAST ALONG THE QUARTER OF THE PROPERTY, THESE TWO FACTORS ARE SPECIFIC TO THIS PARCEL AND ARE NOT APPLICABLE TO ANY OTHER PARCELS IN THE AREA. PLACEMENT OF THE HOME AND THE LOCATION OF THE FLOODWAY ARE NOT A RESULT OF THE ACTIONS OF THE APPLICANT AND THE GRANTING OF THIS VARIANT WILL CONFER ON THE APPLICANT TOUCHED MADE BY OTHER PROPERTIES IN THE RA ZONING DISTRICT. HOWEVER, IN MOST CASES, STRUCTURES ARE BUILT AT THE 40 FEET REQUIRED SETBACK. THE PROPOSED STRUCTURE IS PLANNED TO BE CONSTRUCTED APPROXIMATELY 100 FEET OFF THE ROAD. AGAIN, LITERAL INTERPRETATION OF THE ORDINANCE WOULD NOT DEPRIVE THE APPLICANT OF RIGHTS COMMONLY ENJOYED BY OTHER PROPERTY OWNERS IN THE RA DISTRICT. HOWEVER, BECAUSE OF THE REASONS I PREVIOUSLY SAID THAT THE LOCATION OF THE EXISTING STRUCTURE AND THE FLOODWAY I FEEL THAT THE ACCESSORY STRUCTURE CANNOT BE PROPERTY BUT SHOULD BE PLACED IN THE FRONT OR SIDE YARD. GRANTING OF THE VARIANCE WILL ALLOW THE ACCESSORY STRUCTURE TO BE PLACED ADJACENT TO THE FRONT OF THE EXISTING HOME APPROXIMATELY 211 FOOT SETBACK FROM THE FRONT PROPERTY LINE. GRANTING THE VARIANCE WOULD BE IN HARMONY WITH THE GENERAL INTENT AND PURPOSE OF THE CODE. GRANTING THE VARIANCE SHOULD NOT BE INJURIOUS OR OTHERWISE DETRIMENTAL TO THE PUBLIC WELFARE AS THE STRUCTURE WILL BE PLACED APPROXIMATELY 105 FEET OFF THE FRONT PROPERTY LINE.

THESE FIVE CONDITIONS ARE THE SAME FOR THE BOAT GARAGE AS WELL AS THE VEHICULAR GARAGE. SO, STAFF DID FIND THAT THE REQUEST TO ALLOW THE VARIANCE IS CONSISTENT WITH THE LAND DEVELOPMENT CODE BASED ON THE DISTANCE OF THE EXISTING HOME AND THE SETBACK OFF THE ROAD. AND, THE SPECIAL CIRCUMSTANCES WHICH EXIST ARE NOT A RESULT OF THE APPLICANT'S ACTION.

THEREFORE, STAFF DOES RECOMMEND APPROVAL OF PLACING THESE TWO ACCESSORY STRUCTURES IN THE FRONT OR SIDE YARD. I'M HAPPY
