APPLICANT UP I WILL START WITH >> THE APPLICANT IS VIRGINIA HALL TRUSTEE SUDSIDIARY OF VULCAN.

THE AGENT IS [INDISTINCT] THE SUBJECT PARCEL THE LOCATED 598 COUNTY ROAD 226 AND THIS IS A REQUEST FOR A VARIANCE TO ARTICLE VI, SECTION 6-8, ID TO AID THE REQUIREMENTS FOR A CANOPY TREES WITHIN TEN FEET OF THE PROPERTY LINE AT SPACE NO MORE THAN 50 FEET APART ALONG THE WESTERN BOUNDARY OF THE PROPERTY. HERE IS AN AERIAL, SHOWING YOU THE PARCEL. JUST WESZ OF THAT ALONG THE WESTERN BOUNDARY, AND I'LL GET INTO IT A LITTLE MORE CSX RAIL LINE. WEST OF THAT IS INDUSTRIAL DEVELOPMENT. SUBJECT PARCEL IS APPROXIMATELY 33.4 ACHERS IN SIZE LOCATED IN NORTHWEST QUADRANT OF COUNTY ROAD 229 SOUTH AND COUNTY ROAD 26.

THE PROPERTY IS DESIGNATED DOES TRILLION ON FUTURE USE MAP AND ZONED IV HEAVY INDUSTRIAL. AS I INDICATED IS PREVIOUSLY THE PARCEL ADJACENT FROM THE PROPERTY SAT ACROSS FROM THE CSX RAIL LINE IS INDUSTRIAL ZONE AND ZONED I B HEAVY INDUSTRIAL.

THE PROPERTY IS PROPOSED TO BE UTILIZED IS SAND ROCK STORAGE FACILITY BY FLORIDA ROCK INDUSTRIES.

SAND AND ROCK STORAGE IS ALLOWED IN THE ZONING DISTRICT.

AS PART OF THE PROJECT AGGREGATE WILL BE DELIVERED TO THE SITE VIA CSX RAIL LINE WHICH BORDERS THE PROPERTY ON THE WESTERN BOUND RICHLT AS PART OF THE DEVELOPMENT PLANS FLORIDA ROCK WILL CONSTRUCT RAIL SPURS TO ACCOMMODATE THE DELIVERY OF AGGREGATE AND IN COMPLIANCE WITH CSX STANDARD OPERATING PROCEDURES, THESE SPURSZ WILL BE ALONG THE WESTERN PROPERTY, WESTERN BOUNDARY. THERE ARE SIX CRITERIA TO JUDGE A REQUESTED VARIANCE, I'LL BRIEFLY TOUCH ON EACH OF THOSE.

THE FIRST TWO RELATE TO SPECIAL CONDITIONS AND THE SPECIAL CONDITIONS AND CIRCUMSTANCES WHICH EXIST FOR THIS SITE ARE REALLY RELATED TO SAFETY ISSUES. MAINTAINING THE LINE OF SIGHT FOR SAFE OPERATIONS OF RAIL CARS, ACCESSING AND LEAVING THE SITE AS WELL AS THE WORKERS IN THE STORAGE AREA, CANOPY TREES WHERE THESE NEW RAIL SPURS WILL BE DEVELOPED WILL RESULT IN

VISUAL IMPAIRMENT WHICH COULD POTENTIALLY JEOPARDIZE SAFETY OF WORKERS AND TRAIN OPERATORS. THE SPECIAL CONDITIONS ARE NOT RESULT OF ACTION BY FLORIDA ROCK IT'S PROVIDING SAFETY FOR RAIL OPERATORS AND ON SITE EMPLOYEES. THE GRANTING OF THE VARIANCE WOULD NOT CONFER ANY SPECIAL PRIVILEGE ON THE APPLICANT.

THE APPLICANT HAS COMMITTED TO PLANTING THE REQUIRED CANOPY TREES ELSEWHERE ON THE PROPERTY SO THERE COULD BE NO NET LOSS OF TREES, TREE PLANTING AS REQUIRED BY THE CODE.

LITERAL INTERPRETATION OF THE CODE WOULD LIKELY RESULT IN UNSAFE WORK CONDITIONS AS TREES GROW, THEY WILL RESULT IN VISIBILITY ISSUES, POTENTIALLY IMPACTING WORKERS AND AND OPERATIONS ON THE SITE. THIS WOULD CREATE AN UNNECESSARILY UNDUE HARDSHIP ON THE APPLICANT.

THE REQUESTED VARIANCE IS LIMITED TO WAIVING THE REQUIREMENTS OF THE CANOPY TREES ALONG THE WESTERN BOUNDARY SO THE BACKGROUNDRY THAT FRONTS 209 SOUTH WOULD HAVE THE REQUIRED CANOPY TREES. AND ALTHOUGH THE BENEFICIAL USE IS DEPENDENT GRANTING THE VARIANCE THE VARIANCE WILL PROVIDE FOR SAFER WORKERS AND TRAIN OPERATORS TAN GRANTING OF THE VARIANCE WILL BE IN HARMONY WITH THE INTENT OF THE LAND DEVELOPMENT CODE THE PROMPT ALONG THE WESTERN BOUND HAVE I ALREADY DEVELOPED AND OPERATING AS DOES TRILLION-DOLLAR SO THERE'S NO ADDITIONAL SCREEN OR BUFFERING THAT IS REQUIRED BEYOND THE CANOPY TREE PLANTING THAT IS REQUIRED.

WAIVEING THE REQUIRED CANOPY TREE PLANTING ON THE WESTERN BOUNDARY WILL ENHANCE THE PUBLIC WELFARE BY PROVIDING A SAFE WORK ENVIRONMENT BY MAINTAINING LINE OF SIGHT FOR SAFE OPERATIONS OF RAIL CAR OPERATIONS ON THE SITE. STAFF FINDS THAT THE REQUEST TO WAIVE THE REQUIREMENT OF CANOPY TREES ALONG THE WESTERN BOUNDARY OF THE OPPOSED SAND AND ROCK STORAGE FACILITY IS NOT CONSISTENT WITH THE LAND DEVELOPMENT CODE HOWEVER THERE EXIST SPECIAL CONDITIONS AND THE GRANTING OF THE VARIANCE WOULD BE IN HARMONY WITH THE GENERAL INTENT OF THE CODE AND NOT BE INJURE US TO THE PUBLIC WELFARE STAFF RECOMMENDS APPROVAL OF THE VARIANCE WITH THE STIPULATION THAT THE REQUIRED CANOPY TREES THAT WOULD BE REQUIRED ALONG THE WESTERN BOUNDARY BE PLANTED ELSEWHERE ON THE PROPERTY SO THERE'S NO NETTED LOSS OF THE REQUIRED TREES AND ARE THERE ANY QUESTIONS OF STAFF?

>> YES. THE CODE AND ESPECIALLY THE SECTION THEY'RE ASKING THERE IS A 10 FOOT, THERE'S A REQUIREMENT FOR WITHIN 10 FEET OF THE PROPERTY LINE CANOPY TREES TO BE PLANTED EVERY 50 FEET. AROUND THE WHOLE PROPERTY.

PEOPLE IN CHARGE OF THIS PROJECT AND WITHOUT TAKING UP TOO MUCH OF YOUR TIME, THE PROJECT IS A VERY IMPORTANT PROJECT TO NORTHEAST FLORIDA. WE WILL BE BRINGING AGGREGATE IN BY RAIL, AND AGGREGATE IS AT A, WHAT WOULD YOU CALL THAT? A GREAT NEED IN STRATEGIC RESOURCE.

ACTUALLY IT'S BEEN DECLARED A STRATEGIC RESOURCE BY THE STATE, AND IT IS IN GREAT NEED, AND THIS SITE IS PERFECT FOR IT BECAUSE OF THE RAIL LINE. THE AGGREGATE WILL BE COMING IN EITHER FROM GEORGIA ALABAMA OR IN SOME CASES SOUTH FLORIDA IN THE MIAMI AREA. WE ARE REQUESTING THIS VARIANCE IN ORDER TO CREATE WHAT WE BELIEVE IS A MUCH SAFER WORKING ENVIRONMENT. THESE TREES ACCORDING TO THE CODE, EVEN THOUGH THERE'S IB ON BOTH SIDES OF THE PROPERTY BOUNDARY, IT STILL REQUIRES THE CANOPY TREES EVERY 50 FEET.

THESE 10-FOOT TALL AT THE TIME OF PLANTING AND IT HAS TO BE WITHIN 10 FEET OF THE PROPERTY LINE AND IT'S JUST NOT ONLY NOT PRACTICAL BUT IT REALLY CREATES A LINE OF SIGHT ISSUE FOR THE OPERATORS, BOTH THE RAIL LINE OPERATORS THEMSELVES BECAUSE THERE WILL BE SPURS COMING OFF THE MAIN LINE, SO THAT THE TRAINS CAN DROP OFF THE CARS WITH ROCK AND KEEP GOING WITHOUT SLOWING DOWN FOR TOO LONG OF A PERIOD OF TIME.

AS MR. BROWN DID STATE, WE WILL BE PROVIDING THE EXTRA TREES IN OTHER LOCATIONS. WE ARE ACCORDING, IN ACCORDANCE WITH WHAT'S WRITTEN ON THE VARIANCE DIAGRAM THAT WE PROVIDED, WE WILL BE PROVIDING ABOVE AND BEYOND WHAT'S REQUIRED, 42 MORE TREE POINTS THAN REQUIRED AND ALSO, 46,000 SQUARE FEET OF EXTRA BUFFER. SO WE BELIEVE THAT IN THE SPIRIT, WE ARE DEFINITELY COMPLYING WITH THE CODE REQUIREMENTS. WE THINK THAT STAFF IS CORRECT IN THEIR RECOMMENDATION TO APPROVE.

WE RELY ON THAT COMING TO YOU FOR AS EXPERT TESTIMONY, TO PROVIDE THE BASIS FOR THE APPROVAL.

PRIOR TO THE MEETING TONIGHT I DID SPEND TIME LOOKING AT THE SURROUNDING PROPERTIES IN THAT AREA, SPECIFICALLY THE ONES THAT WERE ALONG THE RAILWAY, AND ACTUALLY, THE ADJACENT PROPERTY THAT YOU WERE DISCUSSING A DISTRIBUTION CENTER, AND THAT DISTRIBUTION CENTER, WHICH IS A LUMBER YARD, I BELIEVE IT'S U.S. LUMBER SOMETHING LIKE THAT ACTUALLY HAS A RAIL SPUR AS WELL.

THERE'S IS SHAPED DIFFERENTLY THERE.

ONE RUNS ALONGSIDE OF THE PROPERTY.

THEIRS GOES IN AND THAT IS THE ONLY WAY COULD I SEE IT GO WITHOUT THIS VARIANCE. HOWEVER WITH THAT BEING SAID THIS PROPERTY IS NOT NEAR THAT SIZE ESPECIALLY AT THE SOUTHERN END. FROM DOING THE WALKING AROUND I DID AND I DIDN'T WALK ON ANYBODY'S PROPERTY, FROM DOING THE WALKING AROUND I DID IT'S PROBABLY A THIRD OF THE SIZE AT THE SOUTHERN END AND I DON'T SEE ANY WAY THAT THEY WOULD BE ABLE TO CHANGE THE SITE PLAN TO BE ABLE TO FIT THAT.

SO WITH THAT BEING SAID I FEEL LIKE THIS IS PRETTY CLEAR CUT TO ME. I AGREE WITH THE FINDINGS OF THE STAFF SAYS. AS WELL AS FLORIDA ROCK'S LETTER. I'M GOING TO SUPPORT THE GRANTING OF THE VARIANCE AN AISLE BE-LAP TO MAKE THE MOTION TO APPROVE. I MAKE THE MOTION TO APPROVE THE
